JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date : 06-08-2019 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for directing the respondent authorities to properly investigate Jainagar P.S. Case No.288 of 2015.

The petitioner is a named accused in Jainagar P.S. Case No.288 of 2015 which was initially registered for the offence punishable under Sections 363, 364 and 379 read with 34 of the Indian Penal Code (for short 'IPC'). 3.
A counter affidavit has been filed on behalf of the State. Learned counsel fo the State referring to the
Patna High Court CR. WJC No.583 of 2017 dt.06-08-2019 2/2 counter affidavit submitted that during investigation the case was found true under Sections 363, 364 and 379 read with 34 of the IPC as also under Sections 302 and 201 of the IPC against all the accused persons including the petitioner. He submitted that during investigation the FIR named accused Lalit Yadav was arrested and he confessed his guilt and on his identification dead body of Dukhani Yadav was recovered. He further contended that on completion of investigation charge-sheet has already been submitted in the case vide charge-sheet no.01 of 2016 dated 07.01.2016.

Having regard to the facts and circumstances of the case, I see no merit in the application. 5.
The application is dismissed, accordingly.
