JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-04-2019 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for a direction to the respondents to release the Pick-up Van bearing Registration No. BR-29R-5204, which has been seized in connection with Maharajganj P.S. Case No. 121 of 2018 registered under Sections 272, 273, 308 and 420 of the Indian Penal Code and Section 41(i) of the Bihar Prohibition and Excise Act, 2016.

Realizing that confiscation is a civil proceeding, learned counsel for the petitioner sought leave to withdraw the present application with liberty to file a civil writ application before this Court in the same subject matter.
