Petitioner seeks pre-arrest bail in Mahila (Motihari)P.S.Case No.11/18 registered under Sections 498A, 341, 323, 342, 504, 354B, 34 of I.P.C. and Section 3⁄4 of D.P.Act. Allegation against the petitioner is of demand of dowry from his wife and subjecting to cruelty due to nonfulfillment of dowry demand. Submission on behalf of the learned counsel for the petitioner is that he is still ready to keep her and he has also filed a case for restitution of conjugal rights. Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, this application is disposed of with a direction to to the petitioner to surrender before the learned
Patna High Court Cr.Misc. No.1340 of 2019(2) dt.18-01-2019 2/2 court below within a period of six weeks from today and pray for regular bail and on his so surrendering he will be released on provisional bail for three months on furnishing bail bond to the satisfaction of court concerned in Mahila (Motihari) P.S.Case No.11 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. In the meantime, the court concerned shall issue notice to the wife of the petitioner and try to reconciliate the matter and if it is found that the petitioner is not at fault and he is ready to keep her, he will confirm his bail bond otherwise he is free to pass any other appropriate order.
