The petitioner seeks bail in connection with Belaganj P.S. Case No.426 of 2023 registered for the offence under Sections 341, 323, 325, 307 and 504/34 of the Indian Penal Code.

The allegation against the petitioner is to have assaulted the informant and her family members, along with other co-accused persons.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that the allegation as regard to assault against this petitioner is general and

Patna High Court CR. MISC. No.6441 of 2024(2) dt.17-02-2024 2/2 omnibus in nature and no specific allegation has been levelled against this petitioner. It is also submitted that there is land dispute between the parties. It is also submitted that similarly situated co-accused person has already been granted bail by a learned co-ordinate Bench of this Court through Cr. Misc. No.68913 of 2023 on 31.01.2024. It is further submitted that the petitioner is a man of clean antecedent and he is in custody since 27.08.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Belaganj P.S. Case No.426 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya.
