JUSTICE SHIVAJI PANDEY ORAL ORDER 06-02-2019 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. In this case, the petitioner is seeking anticipatory bail in connection with Srinagar (Pujaha) P.S. Case No. 49 of 2015 registered for offence punishable under section 302/34 of the Indian Penal Code and 3/4 of the Witchcraft Practices Prohibition Act, 1999.

The petitioner had moved earlier before this Court in Cr. Misc. No. 18781of 2018 and this Court, vide order dated 05.04.2018, rejected the same. The plea has been taken that both the parties have entered into compromise with respect to fact in which a human person was killed.

Looking to the facts and circumstance of the case, this
