JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, this petitioner along with co-accused, Sital Thakur, assaulted the son of informant with Farsa and Dabiya as a result of which he sustained as many as seven injuries.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that there is variation in the manner of occurrence as alleged in the F. I. R. and the statement of injured. It is next submitted that the alleged
Patna High Court CR. MISC. No.4701 of 2022(3) dt.16-05-2022 2/2 occurrence took place on 24.08.2021 but the FIR was lodged on 27.08.2021, after two days of the occurrence without any explanation. Petitioner claims clean antecedent and is in custody since 04.09.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that there is direct and specific allegation against this petitioner and co-accused, Sital Thakur, that they indiscriminately assaulted the injured with Farsa and Dabiya as a result of which he sustained as many as seven injuries.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
