1. Heard learned Senior counsel for the petitioners and learned APP for the State.
2. The petitioners apprehend their arrest in connection with Madhusudanpur P.S. Case no.180 of 2024 registered under Sections 126(2), 115(2), 117(2), 109, 308(3), 303(2), 324(4)(5), 352, 351(2)(3) and 3(5) of the B.N.S, 2023.
3. The allegation in the F.I.R is that all accused persons including the petitioners herein came to the house of the informant variously armed and started abusing the informant. On protest, accused Ajit Kumar Choudhary assaulted the informant by means of iron rod due to which his left leg was fractured while accused Ajay Kumar Bharti along with these petitioners assaulted the brother of the informant by means of lathi and danda due to which he sustained injuries.
4. Learned Senior counsel for the petitioners submits
Patna High Court CR. MISC. No.6504 of 2025(5) dt.25-07-2025 2/2 that it would be apparent from the F.I.R itself that there is general and omnibus allegation levelled against the petitioners of assault upon brother of the informant. Pritam kumar whose injuries are simple in nature caused by hard and blunt substance as per the injury report. He further submits that it is the accused Ajit Kumar Choudhary who assaulted the informant with an iron rod causing grievous injuries on his left leg. The petitioners have no criminal antecedent and undertake to cooperate in the case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. In view of the entire facts and circumstances of the case, it is directed that the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Madhusudanpur P.S. Case no.180 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
