====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-05-2023 Heard learned counsel for the parties.
Petitioner apprehends her arrest in a case registered for the offence punishable u/s 420, 467, 468, 471, 120(B) of IPC. Allegation against the petitioner is that she got appointment to the post of Panchayat Teacher on the basis of forged education certificate.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. She has been falsely implicated in this case. Petitioner has never produced any forged certificate and no show cause was ever asked from the petitioner before initiation of any proceeding against her. It is further stated by learned counsel for the petitioner that petitioner has resigned from the service.
Patna High Court CR. MISC. No.8581 of 2023(2) dt.09-05-2023 2/2 Learned APP for the State as well as learned counsel for the Vigilance opposed the prayer for bail.
Having regard to the facts and circumstances of the case, since the petitioner has resigned from the service, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Vaishali (Belsar O.P) P.S. Case No.444/2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. However, before accepting her bail bond, learned Court below is directed to verify this fact as to whether the petitioner has resigned or not and if it is found that she has not resigned, her bail bond shall not be accepted.
