The petitioners seek bail in a case instituted for the offences under Sections 25(1-B)A, 26 and 35 of the arms Act.
Earlier this Court vide order dated 5.11.2015 passed in Cr. Misc. No. 49359 of 2015 with Cr. Misc. No.49517 of 2015 rejected the prayer for bail of the petitioners with a liberty to renew their prayer for bail after six months in jail custody.
The petitioners are in jail since 3.8.2015 and they have already completed six months in jail custody. Looking to the period of custody, let petitioners, Ajijurahman @ Gama and Amirul Haque, be released on bail
Patna High Court Cr.Misc. No.17533 of 2016 (3) dt.04-05-2016 on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Bhojpur, Ist Class, Gopalganj in connection with Majhagarh P.S. Case No.151 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioners (ii) If the petitioners are found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioners would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioners.
