JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and some others were caught along with the victim in a kidnapping case and it is alleged that one country made loaded pistol and two live cartridges as well as two mobile sets were recovered from conscious possession of the petitioner. The contention on behalf of the petitioner is that having more or less similar allegation, co-accused Raja Sahni and Md. Jainul have already been granted privilege of bail by a co-ordinate Bench of this Court and so far as criminal antecedent of the petitioner is concerned, only two cases had been lodged against the petitioner, prior to the institution of the present case, and both the cases were registered in the year 2002.

No.11756 of 2016 (2) dt.16-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 14.09.2015 and, furthermore, with an intent to maintain the parity of justice, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Khagaria in connection with Parbatta ( Bharthkhand) P.S.Case No. 283 of 2015.
