JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 Petitioner apprehends his arrest in connection with Warisnagar P.S. Case No. 132 of 2018 registered for the offences punishable under Sections 273 of the Indian Penal Code, 30(a), 38 and 41 of Bihar Prohibition and Excise Act. Allegation as per FIR is of recovery of total 1750.680 litres of liquor from the truck and it is alleged that petitioner succeeded in fleeing away along with other accused persons. Submission of learned counsel for the petitioner is that the truck does not belong to the petitioner and there is no other specific allegation against him and there is no recovery from his possession and other co-accused persons have been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 1.8.2018 passed in Cr.Misc.No. 46829 of 2018 and vide order dated 12.10.2018 passed in

Patna High Court Cr.Misc. No.1152 of 2019(2) dt.17-01-2019 2/2 Cr.Misc.No. 56322 of 2018.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III-cum-Special Judge, Excise, Samastipur, in connection with Warisnagar P.S. Case No. 132 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
