The petitioner seeks bail in connection with Kundwachainpur P.S. Case No. 241 of 2021 instituted for the offences under Sections 30(a) and 41(1) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 01.11.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 450 litres of liquor from a Bolero. Learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the said vehicle rather had taken lift and came to be implicated when search was

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran at Motihari in connection with Kundwachainpur P.S. Case No. 241 of 2021.
