JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 11.1.2016 in a case registered under Section 366(A)/34 of the Indian Penal Code. The victim has already returned to her home and her statement under Section 164 of the Cr.P.C. has been recorded. In the aforesaid statement, victim stated that she was taken away by the petitioner and one unknown person and she was kept by the petitioner for near about 15-16 days, but subsequently, when police came, the petitioner fled away leaving behind the victim. Learned counsel for the petitioner submits that the petitioner and victim were in love and, as a matter of fact, the victim eloped with petitioner, but when she came under the control

Patna High Court Cr.Misc. No.11833 of 2016 (2) dt.17-03-2016 2/2 of her parents, she took 'U' turn and stated a different story in her statement recorded under Section 164 of the Cr.P.C. Considering the facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri S. Ram, J.M., Supaul in connection with Triveniganj P.S. Case No.193 of 2015.
