The petitioner seeks bail in anticipation of his arrest in connection with Madhuban P. S. Case No. 179 of 2018 dated 09.09.2018 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 72 litres of liquor is said to have been recovered from the house of one Baidnath Sah who has disclosed the name of the petitioner and others. The other accused persons, who have been named by Baidnath Sah, have been granted anticipatory bail by a Bench of this Court vide order
Patna High Court Cr.Misc. No.613 of 2019(2) dt.17-01-2019 2/2 dated 18.12.2018 passed in Cr. Misc. No. 75052 of 2018. Regard being had to the aforesaid facts as also the clean antecedents of the petitioner, he, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge cum Special Judge, Excise, Motihari, East Champaran in connection with Madhuban P. S. Case No. 179 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
