JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 387, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
In course of investigation, the name of this petitioner came in confessional statement of co-accused, Binod Rathor and subsequently, one Apache motorcycle is said to have been recovered but submission on behalf of the petitioner is that having similar allegation, one co-accused, Yashwant Kumar Sharma has already been granted privilege of bail and petitioner does not have any criminal antecedent.

No.13847 of 2016 (2) dt.04-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 691 of 2015.
