Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Jokihat P.S. Case No. 196/2020 instituted for the offences under Sections 147, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. An occurrence is said to have taken place when a shop was being constructed. Several persons have been made accused in this case. So far as the petitioner is concerned, he is said to have assaulted one Mr. Rafique by means of farsa. However, the injuries suffered by the aforesaid Rafique have been opined to be simple in nature.

No.14626 of 2021(2) dt.06-01-2022 2/3 The learned counsel for the petitioner has submitted that the co-accused Mansoor had obtained a plot of land which is located in front of a Government land. On the date of occurrence, the informant and his associates were trying to construct a shop over the Government land with an intention to grab it. When a protest was made, such an occurrence is said to have taken place.

There is a counter version of the occurrence also.

Several persons are alleged to have congregated at the place of occurrence and 17 persons including the petitioner have been named.

Regard being had to the afore-stated facts, the petitioner above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jokihat P.S.
