The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 10839 of 2019 arising out of Malsalami P.S. Case No. 445 of 2019, dated 02.12.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Patna High Court CR. MISC. No.7588 of 2020(2) dt.10-06-2020 2/3 It appears that 750 ml. of liquor was recovered from a motorcycle. Local villagers are said to have informed the police that the aforesaid motorcycle belongs to the petitioner.
Learned counsel for the petitioner has submitted that his name has wrongly been provided by the local police. In fact, the petitioner is a student and he had spotted the motorcycle belonging to his father being driven by somebody else, which was intercepted. In any view of the matter, the petitioner was not found riding the motorcycle. The petitioner is a person of young age and is pursuing his studies.
Regard being had to the facts aforestated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case No. 10839 of 2019 arising out
