The petitioner is languishing in custody for the offences punishable under Section 414 of the Indian Penal Code, Sections 45(i)(xii)/46(viii) of the Prisoners' Act and Sections 20/22 of the N.D.P.S. Act.
The petitioner is in custody since 16.10.2019. When the petitioner was in jail 20 grams of opium was recovered from his possession.
In the past prayer for bail was refused by a coordinate Bench of this Court vide order at Annexure-1. The report of the trial Judge reveals that even police papers have not been supplied to the petitioner as required under Section 207 Cr.P.C.
Patna High Court CR. MISC. No.14790 of 2021(3) dt.29-09-2021 2/2 Since there is no chance of early start of the trial and no material to substantiate that petitioner is going to tamper with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Thawe P.S. Case No.183 of 2019 with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
