Petitioner seeks bail in a case registered under sections 302/34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case in short is that while the informant and his brother were working as helper in the sweet shop on 11.06.2014 the neighbours informed him at 9.30. P.M. that some persons are making fire entering into his house. The rushed towards their house and found that all the inmates of their house had gone to Sadar hospital Munger. It is learnt that the neighbours Suraj Kumar and Deepak Kumar along with three and four unknown persons have fired four shot causing injury to Dinesh Kumar, having trespassed in to his house. Patna High Court Cr.Misc. No.22111 of 2015 (2) dt.16-07-2015 2/2 hospital referred the injured Dinesh Kumar at Maya Ganj Hospital Bhagalpur where he succumbed to the injury.

On behalf of the petitioner it has been submitted that petitioner is not named in the first information report. Further it has been submitted that petitioner is in custody since 2.03.2015 and charge sheet has been submitted in the case. It has further been submitted that other co-accused has been granted bail vide annexure-3.

On behalf of the stated it has been submitted that petitioner's name has come during the course of investigation. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Munger in Kasimbazar P.S.
