The petitioners seek bail in connection with Mohania P.S. Case No. 748 of 2023 instituted for the offence under Section 302/34 of the Indian Penal Code. 3.

As per prosecution case, informant has alleged that her daughter was married to the son of the instant petitioners 15 years ago. It is further alleged that she has been done to death, at her matrimonial home due to strangulation but he has been informed that the death is caused due to stomach pain.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 21-10-2023. Petitioners bear one criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. It is submitted that petitioner No. 1 is father-in-law and petitioner No. 2 is mother-in-law and their implication is by virtue of their relationship with the husband of the deceased. Husband is already in custody. The allegation against the petitioners is general and omnibus and no specific allegation is attributed against them. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners and old age of the petitioners being father-in-law and mother-in-law, this Court is inclined to grant bail to the petitioners. 8.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of
