The petitioner seeks bail in connection with Naugachhiya Rail P.S. Case No.02 of 2015 for the offence punishable under Section 354 of the Indian Penal Code.

The prosecution story, in brief, is that on 27.03.2015, when the informant along his daughter-in-law was sitting in the train, a person tried to outrage modesty of his daughter-in-law, namely, Jhalak Sharma, On seeing the act of petitioner, the passenger of the train raised hulla and with the help of G.R.P. Police, the said person was apprehended. On query, he disclosed his name as Sanjay Rakshit.

It has been submitted on behalf of the petitioner that the petitioner has been made accused in the present case due to

Patna High Court Cr.Misc. No.23500 of 2015 (2) dt.11-06-2015 2/2 mistake of fact. Further it has been submitted that the petitioner has no criminal antecedent and he is in custody since 30.03.2015. It has further been submitted that the petitioner may be released on bail after completion of six months in custody. On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail, after completion of six months in custody, on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Khagaria in connection with Naugachhiya Rail P.S. Case No. 02 of 2015.
