The petitioner is in custody in a case registered under Sections 25(1-B)A/26/35 of the Arms Act.
The prosecution case, in brief, is that one Dani Prasad Singh, A.S.I. of Barbigha Police Station lodged a written report before the Officer-in-Charge, Barbigha Police Station stating therein that on 12.8.2014, he got information on mobile that a person with illegal arm has been demanding ransom from the shop Krishna Bhalotia. On such information, he along with other police personnel reached the shop and found a boy armed with country made pistol tried to flee away but he was arrested with the help of SAP force. Patna High Court Cr.Misc. No.22066 of 2015 (2) dt.14-07-2015 2/2 could not disclose anything nor show any valid paper. The second one, who fled away, was well known to the informant and disclosed his name as Makku.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.8.2014 and charge sheet has been submitted in the present case. It is further submitted that as per the F.I.R., one country-made pistol and one live cartridge are said to have been recovered from the possession of the petitioner. The petitioner has remained in jail for more than six months.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sheikhpura, in connection with Barbigha P.S.
