Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,307,379,504 and 302 of the Indian Penal Code.
According to FIR, the petitioner is one of the assailants of the uncle of the informant by causing injury with Kulhari. The general and omnibus allegation is against others also.
Learned counsel for the petitioner has drawn attention of the Court towards the statement of the injured recorded in para-44 of the case diary. The statement, does not
Patna High Court CR. MISC. No.3491 of 2020(3) dt.30-06-2020 2/2 make any difference in the prosecution case.
Learned counsel for the State opposed the prayer for anticipatory bail.
Considering the direct allegation, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Wajirganj P.S.Case No.157 of 2019 pending in the court of learned Additional Chief Judicial Magistrate-1st, Gaya. Hence, prayer is refused.
Petitioner is directed to surrender and pray for regular bail.
