2. The petitioner-Anil Kumar, respondent no. 12-

Patna High Court CWJC No.1264 of 2022(6) dt.31-01-2023 2/3 Nutan Kumari, SHO, Riga and Circle Officer, Riga have appeared in person in the Court.

3. It is informed by the petitioner and respondent no. 12 that mud is deposited in the midst of the road which has obstructed the three feet passage being commonly used by the petitioner and respondent nos. 9 to 12. It is now informed by respondent no. 12 who is present in Court that some mud is illegally deposited by Lalita Devi wife of Nand Kishore Ram in the middle of the road which is causing inconvenience to the inhabitant( who are the petitioner and respondent nos. 9 to 12).

4. The Circle Officer, Riga and SHO, Riga have ensured that they will make proper inquiry into the matter and if it is found that the mud which has illegally been deposited by one Lalita Devi wife of Nand Kishore Ram or any other person in the midst of the road then they will immediately take action to remove the same forthwith.

5. This Court directs the Circle Officer, Riga and the SHO, Riga, if in case no one admits that they have deposited the mud in the midst of the road, then the same is required to be removed at the level of the Circle Officer, Riga with the help of SHO, Riga and for which petitioner along with respondent nos. 9 to 12 are liable to make payment along with the damages

Patna High Court CWJC No.1264 of 2022(6) dt.31-01-2023 3/3 caused and expenses incurred by the Circle Office, Riga.

6. This Court appreciates the effort taken by the Circle Officer, Riga and SHO, Riga in resolving the dispute among the parties.

7. Accordingly, the present writ petition, stands disposed of.
