The petitioner seeks regular bail in connection with Paraiya P.S.Case no.130 of 2019 registered for offences punishable under Sections 341, 337, 307, 302 and 34 of the Indian Penal Code.

As per the FIR, there is allegation against the petitioner of throwing bricks causing injury to the son of the informant on head , further allegation is that he has also assaulted his mother by brick causing injury and she succumbed to the injuries. Learned counsel for the petitioner drawing my attention towards annexure-2 has submitted that he is physically handicap and it is not possible for him to throw the brick and moreover there was no intention of causing death. He is in

Patna High Court CR. MISC. No.3666 of 2020(4) dt.04-02-2020 2/2 custody for more than five months. Charge sheet has been submitted.

Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail on the ground that even the son of the informant has received grievous injuries. Apart from that the the deceased has also received injuries by brick .

Having heard both sides and in view of submissions as made above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Gaya in connection with Paraiya P.S.Case No.130 of 2019.

With the above direction, this application is allowed.
