Petitioner, being husband of deceased, has been made accused in a case initially, registered under Sections-304B/34 of the Indian Penal Code but after investigation, police submitted charge sheet under Sections-306, 120B/34 of the Indian Penal Code.
It would appear from perusal of the case diary that in course of investigation, almost all the witnesses stated that at the time of alleged occurrence, the petitioner was in abroad in connection with his livelihood and the aforesaid statements of witnesses are fortified by Annexures- 2 & 3 of this petition. Considering the above-said facts and circumstances of
