Petitioner seeks bail in a case registered under sections 498(A) 304(B) 201/120B of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

According to the prosecution case the deceased was married to one Mithun Ram. It is alleged that soon after the marriage when the deceased came at the matrimonial home there was demand of dowry. On account of nonfulfilment of the demand of dowry the deceased was done to death and was thrown into a well. The dead body of the deceased was recovered from there.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.21127 of 2015 (2) dt.13-07-2015 2/2 that petitioner is in custody since 30.05.2014 and charge sheet has been submitted in this case. It is further submitted that petitioner is the elder brother of the husband of the deceased and he has no concern with the husband of the deceased. Other accused persons have been granted bail vide Annexure-2 series. On behalf of the State it is submitted that petitioner is name in the first information report. Considering the aforesaid facts, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of 3rd Additional Sessions Judge, Siwan in connection with S.Tr. No. 24 of 2015 arising out of Assaon P.S. Case no. 28 of 2014.
