The petitioner is in custody since 24.10.2019 in connection with N.D.P.S. Case No.69 of 2019, arising out of Barachatty P.S. Case No.501 of 2019 registered for the offence under Section 20/22 of NDPS Act, 1985.

Learned counsel for the petitioner submits that the allegation against the petitioner is that from his possession 3 kilograms of Doda power was recovered and he has been taken into custody on the said allegation. It is further submitted that the alleged substance is much less than the commercial quantity in the NDPS Act and there is no allegation that the petitioner has been in business of said substances. It is further submitted that the petitioner had no knowledge of the recovery of such items

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent and the alleged recovery are less than the commercial quantity, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (N.D.P.S.) Act, Gaya, in connection with N.D.P.S. Case No.69 of 2019, arising out of Barachatty P.S. Case No.501 of 2019.
