Petitioner seeks bail in a case registered under sections 435, 427, 34 of the Indian Penal Code and 17 of the C.L.A Act.

Prosecution case in short is that one Ratan Kumar Singh of Tanuj Enterprises made a report before Shikarganj P. S. stating there in that he was constructing Shkarganj Haraj-nurullahpur road under Prime Minister Road Yojna and on 27.011.2012 at 12 to 12.30 P.M. in night some unkno23n criminal set fire to his vibrating roller and crusher and when the fire was burning his Munshi Raj Kumar when wake up to attend call of nature he saw that the said roller and crusher

Patna High Court Cr.Misc. No.21091 of 2015 (2) dt.13-07-2015 2/2 were burning . Thereafter the villagers came and control the fire. It has been submitted on behalf of the petitioner that charge sheet has been submitted in the case. It is further submitted that the petitioner is in custody since 12.11.2013. It is further submitted other co-accused persons have been granted bail vide Cri. Misc. No. 52330 of 2013 and Cri. Misc. No. 13479 of 2013.

On behalf of the State it is submitted that petitioner's name has come during investigation. Considering the aforesaid facts, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Umashanker, J.M. Ist Class, Sikarhana at Motihari, East Champaran in Chiraiya (Shikarganj) P.S. Case No. 275 of 2012.
