2. The petitioner has preferred this application for grant of regular bail in connection with Larjhaghat P.S. Case No. 37 of 2024 dated 04.07.2024 registered for the offences punishable under Sections 80(2), 238 read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have committed murder of the informant's daughter due to non-fulfillment of demand of Rs. 2 lakh and a motorcycle as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner

Patna High Court CR. MISC. No.5582 of 2025(2) dt.03-03-2025 2/2 who is the cousin father-in-law of the informant. The petitioner neither demanded any dowry nor tortured the informant. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 18.10.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner. As per the statement recorded under Section 161 of the Cr.P.C., the informant and the other witnesses have supported the prosecution case and also stated that the petitioner is one of the accused persons who involved in disposing the dead body of the deceased.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st class, Rosera (Samastipur) in connection with Larjhaghat P.S. Case No. 37 of 2024.

7. The application stands allowed.
