Petitioners apprehend their arrest in connection with Mashrakh P.S. Case No.217 of 2019, registered for the offences punishable under Sections 147, 148, 341, 323, 302, 504 and 506

Patna High Court CR. MISC. No.72882 of 2022(3) dt.05-05-2023 2/3 of the Indian Penal Code.

Accusation against the petitioners and other coaccused persons is of killing the son of the informant. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is no eye witness of the occurrence and only on suspicion, the petitioners have been made accused. It is also submitted that similarly situated co-accused persons have already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 15.09.2022, passed in Cr. Misc. No.58517 of 2021.

The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saran at Chapra in connection with
