JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Rani Talab P.S. Case No. 238 of 2017 for offences under Sections 407, 409, 419, 420 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

The allegation against the petitioner is that after loading of sand from buffer stock on the truck but instead of unloading at Ramjichak, the petitioner has unloaded sand at Bata More.

Considering the fact that the petitioner has no criminal antecedent, this Court is inclined to grant bail to him. Let petitioner, above-named, in the event of arrest or surrender
