The petitioner apprehends his arrest in connection with Sonepur P.S. Case No. 662 of 2019 registered under Section 30(a) of the Bihar Excise Act pending in the Court of Special Judge, Excise Act, Saran.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case mere on suspicion. Further submission is that petitioner has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that huge quantity of illegal IMFL has been recovered while unloading from the alleged truck by the police. The petitioner and others

Patna High Court CR. MISC. No.4038 of 2020(2) dt.22-01-2020 2/2 were involved in doing business of the said illegal liquor. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
