The petitioner is languishing in custody since 06.04.2015 in a case registered for the offences punishable under sections 447/341/323/324/307/379/504 of the Indian Penal Code. The accusation against the petitioner is of assaulting on the head of the son of the informant. It is submitted by learned counsel for the petitioner that in the background of bona fide land dispute the accusation has been levelled. Initially, the injury was found simple in nature but, subsequently, it was found grievous. There is no accusation of repeating the blow. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Bhargama P.S.
