The petitioner seeks bail in connection with Tetarhat P.S. Case No. 110 of 2025 instituted for the offence under Sections 115(2), 126(2), 76, 109(1), 118(1), 303(2), 352 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

The prosecution case, in short, is that on 10.06.2025, a dispute arose when the cow of petitioner entered the informant's courtyard, following which the accused persons came to her house and abused her. It is alleged that petitioner assaulted the informant's husband on the head with a Garasa causing serious injury, while the other accused outraged the modesty of the informant and snatched her mangalsutra,

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.10.2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Parties are villagers. There is delay of one day in lodging the FIR. The present case is the counter version of Complaint Case No. 309 of 2025 filed by one Ripu devi, who is wife of coaccused, Ranjit Singh against the informant and others. Injury of the injured is found to be grievous in nature caused by hard and blunt object, which further falsifies the allegation of assault by means of Gadasa, a sharp edge weapon.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and there being case and counter case between the parties, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of

Patna High Court CR. MISC. No.7134 of 2026(2) dt.04-02-2026 3/3 Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Tetarhat P.S. Case No. 110 of 2025, subject to the following conditions:

(I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
