Vide order dated 26.07.2021 case diary along with the status report was called for. In compliance thereof, a report dated 06.08.2021 has been received in this Court, which is at Flag 'A' to this application. In his report the learned JMFC, Sherghati, Gaya has, inter alia, stated that cognizance has been taken against 11 accused persons, out of which nine accused person has not appeared as yet in the Court. The record of absent accused person was ordered to be split up and the case record of two accused persons including the petitioner has been committed to the Court of Sessions.
In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for bail is
Patna High Court CR. MISC. No.15069 of 2021(3) dt.05-10-2021 2/2 hereby rejected.
However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within one year from the date of receipt/production of a copy of this order. Both the parties are expected to extend their co-operation in conclusion of the trial. The Superintendent of Police, Gaya is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
Let a copy of this order be sent to the Superintendent of Police, Gaya for needful.
