The petitioner seeks bail in Barari P.S. Case No. 02/2015, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act and Section 3(2)(5) of the SC&ST Act.

Three persons are named in the FIR. The petitioner, Dhananjay Yadav and Kumod Yadav are alleged to have come to the wine shop of the informant. There was some verbal altercation. When Sunil, the brother of the deceased went to pacify the matter, the petitioner Puran Yadav is said to have caught the hand of Sunil. Kumod Yadav and Dhananjay Yadav made firing causing death of Guddu, son of the informant. The inquest report found only two injuries. Post-mortem report also shows two wounds. The petitioner did not even touch the body of the deceased. The

Learned counsel for the informant vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Barari P.S.
