In this case, the petitioner is seeking regular bail in connection with Dhamdaha P.S. Case No.252 of 2015, registered for the offence punishable under Sections 363, 366A, 120-B, 323 and 379/34 of the Indian Penal Code.

As per the allegation, the petitioner took away the minor daughter of the informant by alluring and enticing her. Further, allegation has been made that 8 to 10 persons misbehaved and assaulted the informant. However, the statement of the girl recorded under Section 164 of the Cr.P.C itself shows that she went Dhamdaha to see the fair, as she was feeling very hungry, she went to a hotel, where a person gave one glass of water and she requested the person to drop her to village. In stead of

Having considered the aforesaid facts and circumstances of the case, let the petitioner-Chhotu Rishideo @ Chhotu Kumar Rishi be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S.
