JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chausa P.S. Case No. 86 of 2018 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code, Sections 25(1-b)a, 26, 27, 35 of the Arms Act and 30(a) of Bihar Prohibition and Excise Act, 2016. Allegedly, petitioner and several other persons on different motorcycles came near the place of occurrence and when police party tried to intercept them, they opened fire on the police party and fled away from there leaving behind their motorcycles. However, one person was caught who disclosed the name of the petitioner and others. Firearm was recovered

Patna High Court CR. MISC. No.4890 of 2020(2) dt.29-02-2020 2/2 from possession of apprehended person as well as from the place of occurrence.

Submission on behalf of the petitioner is that one coaccused, having more or less similar allegation, has already been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 05.09.2018 passed in Cr. Misc. No. 53380 of 2018.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner does not have any criminal antecedent, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd cum Special Judge, Excise Act, Madhepura in Chausa P.S. Case No. 86 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
