Mr.Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Complaint Case No. 2235 C of 2018 disclosing offence under Section 406 of IPC.

Prosecution case is of taking Rs.9 lakhs from the father of the complainant by the petitioner and he has not returned the same.

Submission of the learned counsel for the petitioner is that as a matter of fact, he has taken only 4,20,000/- and rest of the amount was adjusted and spent in the case of seizure of vehicle of the father of the complainant also in the treatment of his father. It has further been submitted that till the father of complainant, no case was lodged and thereafter, the present case

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Patna, in connection with Complaint Case No. 2235 C of 2018.
