JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of complainant is languishing in custody since 17.01.2016 in a case registered for the offences punishable under sections 341, 323, 379, 498A/34 of the IPC.

The basic accusation is of torture.

It appears that the complaint was filed in the year 2009 and cognizance has been taken on 13.04.2010 under Section 341, 323, 379, 498A/34 of the IPC and under Section 3⁄4 of Dowry Prohibition Act but the petitioner is in custody since 17.01.2016. It is submitted by learned counsel for the petitioner that petitioner admits the marriage with the complainant and he is still ready to keep the complainant with dignity and honour. There is no injury report on record.

No.14835 of 2016 (2) dt.06-04-2016 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Complaint Case No. 898 C of 2009. The learned court below shall cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions.
