It appears that on 02.09.1991 on the basis of the application filed by the appellant stating that certified copy of the Judgment under appeal has been filed in First Appeal No.82 of 1989 vide paragraph 5 of the application for analogous hearing of this First Appeal along with First Appeal No.82 of 1989, this Court passed the order to the effect that this appeal shall be heard along with the first Appeal No.120 of 1989 and 121 of 1989 and the filing of certified copy of the Judgment was dispensed with. Thereafter, the office pointed out that certified copy of the Judgment under appeal is not filed in First Appeal No.82 of 1989 and records of First Appeal No.120 of 1989 and First Appeal No.121 of 1989, therefore, the appellant was again directed to file certified copy of the Judgment under appeal by terms of order dated 26.04.2012
Patna High Court FA No.119 of 1989 (5) dt.25-03-2015 2 / 2 whereby the appellant was to remove the defect No.1 relating to the filing of the certified copy of the Judgment under appeal. Likewise the other two defects pointed out by the office have also not been removed in spite of the order passed by the Bench on 26.04.2012.
