The petitioner is in custody in a case registered under Sections 302 and 201/34 of the Indian Penal Code. The prosecution case, in brief, is that the informant Gaya Manjhi on the request of one Awadhesh Chaudhary went to Gaya on 26.2.2014 for the treatment of his Bahnoi, namely,Dashrath Chaudhary, and thereafter after treatment they returned to their home, but on the next day on 27.2.2014 at 6.00 A.M. the informant got knowledge that the dead body of his father Karu Manjhi was lying near a wheat field. He has the apprehension that some villagers, namely, Satan Manjhi, Bhukhal Manjhi, Jagdish Manjhi, Ramashish Manjhi, Nepal
Patna High Court Cr.Misc. No.21313 of 2015 (2) dt.13-07-2015 2/2 Das and Kamta Das were involved in the murder of his father and on the basis of his statement the present named F.I.R. has been lodged against them.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.12.2014. It is further submitted that the petitioner is not named in the F.I.R. It is further submitted that the other co-accused have been granted bail, vide Cr.Misc. No.6369 of 2015.
On behalf of the State, it has been submitted that the petitioner has been named in the present case in course of investigation.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss.Akanksha Kashyap, learned Judicial Magistrate, 1st Class, Gaya, in connection with Konch P.S. Case No.29 of 2014.
