JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section414 of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.

Petitioner was caught along with the motorcycle and one country-made pistol containing one cartridge is said to have been recovered from his conscious possession and so far as the seized motorcycle is concerned; the petitioner claimed that the aforesaid motorcycle belonged to him.

Learned counsel for the petitioner submits that the petitioner has filed documents, claiming the ownership of the aforesaid motorcycle, which has been annexed with this petition as

Considering the above-said facts and circumstances of the case as well as period of detention of the petitioner in jail custody and also, taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mohammadpur P.S. Case No. 195 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj. (Hemant Kumar Srivastava, J) A.K.V./- U T
