The petitioners are languishing in custody since 29.08.2014 and 02.12.2014 in a case registered for the offences punishable under Sections 25(1-B)a/26 of the Arms Act and 17 of Criminal Law Amendment Act.

On secret information the house of petitioner Tuntun Sahni was raided when from a polythene bag containing levy receipt, pocket diary, paper, copy, register and one cartridge were recovered. The petitioner Tuntun Sahni confessed that he in league with his brother petitioner Ram Pravesh Sahni carries on the naxal activities.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.21223 of 2015 (02) dt.07-07-2015 2/2 petitioners that the investigation has already concluded. Considering the nature of recovery and the period under custody, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Cheria Bariyarpur P.S. Case No. 171 of 2014. Since the petitioners are accused in seven other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioners, if they substantially get involved in some serious nature of offence or default for two consecutive occasions.
