JUSTICE ARUN KUMAR ORAL ORDER 11-10-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Rahui (Bhaganbigha) P.S. Case No.187 of 2016, registered under Sections 304(B)/34 of the Indian Penal Code.

It is submitted that the daughter of the informant died of diarrhea, even in the post-mortem report no cause of death was ascertained, no poison has been detected in the viscera report and in fact the petitioner and the daughter of the informant both had eloped and married, so there is no question of making any demand of dowry.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named

Patna High Court Cr.Misc. No.20475 of 2017 (7) dt.11-10-2017 2 /2 above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nalanda at Biharsharif in connection with Rahui (Bhaganbigha) P.S. Case No.187 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. as well as subject to the condition that the petitioner shall be present on each and every date before the trial court as and when required and in case of absence on two consecutive dates except in case the petitioners falls ill and is unable to attend the court, his bail bond shall be liable to be cancelled.
