2. The petitioner, who is in custody since 12.12.2017 in connection with Danapur Railway P.S. Case No. 123 of 2017 for the offences alleged under Section 379 of the Indian Penal Code, has renewed his prayer for bail having twice been rejected by orders dated 16.03.2018 and 24.08.2018 passed in Cr. Misc. No. 12202 of 2018 and Cr. Misc. No. 42743 of 2018 respectively, with liberty to the petitioner to renew his prayer for bail after completing one year in jail custody.

3. Be that as it may, having regard to the entirety of the facts and circumstances of the case as well as the period of custody since 12.12.2017 already suffered, let the petitioner

Patna High Court Cr.Misc. No.792 of 2019(2) dt.30-01-2019 2/2 above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM Railway Court, Patna, in connection with Danapur Railway P.S. Case No. 123 of 2017 with the following conditions:

(i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
