JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioners and the State.
The petitioners are languishing in custody since 01.02.2015 and 03.09.2014 in a case registered for the offences punishable under sections 399,402,414,416A and 120B of the Indian Penal Code.
On secret information that the miscreants are preparing to commit dacoity, house of Baijnath Ram was raided,
Patna High Court Cr.Misc. No.22373 of 2015 (2) dt.09-07-2015 2/2 from where co-accused Dhirendra Yadav, Umesh Kumar, Bechan Yadav and Ashok Kumar Mandal were apprehended from whom some recoveries were made. In the confession of the apprehended accused, the name of the petitioners surfaced. It is submitted by learned counsel for the petitioners that there is no recovery from the petitioners and the petitioner Subhash Yadav is involved in one other case whereas petitioner Manoj @ Bambam Yadav is accused in several cases. Considering the fact that the name of the petitioners sprang up in confession, let them be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur in connection with Birpur P.S. Case No.169 of 2013.
Since the petitioner Manoj @ Bambam Yadav has serious criminal antecedent, learned court below will be at liberty to cancel his bail bond, if he defaults for two consecutive occasions or gets involved in some serious nature of offence. (Dinesh Kumar Singh, J) Ashwini/- U T
