JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner confessed his guilt when he was arrested in a separate case but allegedly he suppressed his criminal antecedent while pressing bail petition before the court below and taking account the aforesaid fact learned court below rejected the bail prayer of the petitioner though earlier the petitioner had been granted bail by the concerned court.
Considering the facts aforesaid and submission of the parties and also taking into account the fact that, except present case as well as Chainpur P.S. case No. 106 of 2015, the petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua in connection with Bhabua P.S. case No.251 of 2015.
