Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sarai P.S. Case No. 255 of 2020 lodged under Sections 20/22/23/24 of the N.D.P.S. Act.

As per the prosecution case, total recovery of 12.024 Kg of Ganja has been made, which is subject matter of the present case. The said Ganja alleged to be recovered from a car, in which total four persons were sitting.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 04.11.2020 having

Patna High Court CR. MISC. No.3988 of 2023(3) dt.05-06-2023 2/2 clean antecedent. Counsel further submits that out of four accused persons, two persons have been granted bail by the Coordinate Bench of this Court in Cr. Misc. No. 38288 of 2022 vide order dated 30.11.2022 (Annexure-2). Counsel submits that chargesheet has already been filed in this case. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Vaishali at Hajipur in connection with Sarai P.S. Case No. 255 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
